1. Introduction

BHH B.V. (hereinafter: “BHH” or “we”) attaches great importance to the protection of your personal data. In this privacy statement we explain which personal data we collect, for what purposes, how we process it and which rights you have. 

This privacy statement applies to all processing of personal data by BHH, including the processing via our websitewww.the-autogram.com(hereinafter: “the website”), the dispenser with integrated scales, the app and the cloud service that BHH offers.

2. Who are we?

BHH is the controller within the meaning of the AVG for all processing of personal data described in this statement.

3. Which personal data do we process?

3.1 Data via our website / contact

  • Business contact details: name of contact person, company name, business e-mail address, business telephone number, position.
  • Correspondence: information that you provide to us in a (contact) form or e-mail.

 

3.2 Data for purchase and delivery (B2B)

  • Order and invoicing data: company name, address details, Chamber of Commerce number, VAT number, contact person name, financial information (bank account, payment details).

 

3.3 Data via the dispenser, app and cloud service

  • Account information (for the app/cloud): User name, email address (business or personal, depending on what the customer uses) and login details.
  • When using the app, an account can be linked to one or more physical products, so that recipes and settings can be synchronized and the use of the product can be supported.
  • Recipes and usage dates: Ingredients, recipes, machine settings, use log data (amount of ingredients used, date / time of use), technical data (error messages, software versions, etc.).
  • Calibration and maintenance dates: Maintenance and calibration records that we (or authorized service partners) perform.
  • The customer is responsible for the content and correctness of the entered recipes, ingredients and settings. BHH does not determine the content of this data and only uses it as described in this privacy statement.

 

Because the dispenser and app are mostly used in a business context, we mainly expect business data. Do you still process personal data of employees? This data will also continue to fall under this privacy statement.

4. Purposes and legal basis

1- Execution of the agreement (B2B)

  • Processing (contact) data to prepare quotations, to process orders, deliver products and invoke.
  • Legal basis: execution of the agreement.

2- Delivery and management of the dispenser, app and cloud service

  • To be able to store and synchronize recipes, to collect usage data (eg for support), to be able to perform updates.
  • Principle of justice: Execution of the agreement and / or legitimate interest (eg product improvement).
  • BHH can analyze usage data, technical data and information about the use of ingredients to improve the operation, reliability and functionality of the product, app and cloud service.
  • Where possible, these analyzes are performed on anonymised or aggregated data, so that the results cannot be traced back to individual users, accounts or companies.

3- Maintenance, service and support

  • Contact in case of malfunctions, machine maintenance and calibrations; Processing log data to diagnose technical problems.
  • Legal basis: implementation of the agreement and / or legitimate interest (quality control).

4- Commercial communication and marketing

  • Sending business newsletters or information about new products / services (if within applicable B2B rules or based on permission).
  • Legal basis: legitimate interest (B2B relationships) or consent (if required by law).

5- Legal obligations

  • Data processing to comply with administrative, tax and other legal obligations.
  • Legal basis: legal obligation.
  • BHH does not use automated decision-making or profiling within the meaning of Article 22 of the AVG.

5. How long do we keep your data?

We do not store personal data for longer than is necessary for the aforementioned purposes or on the basis of legislation and regulations. In practice, for example, we use:

  • Business (contract) data: 7 years (tax retention obligation).
  • Usage and recipe data in the cloud: as long as the agreement runs and / or as long as you actively use the service. If you delete your account or the agreement ends, we delete or anonymize this data after a reasonable period of time, unless we have to keep the data longer for legal or security reasons.
  • Correspondence: 2 years after processing, unless longer necessary.

6. Share with third parties

We only share personal data with third parties if this is necessary for our services or on the basis of a legal obligation, such as:

  • Logistics partners (transport companies) for delivery of the dispenser or parts.
  • Payment and billing partners (bank, accountant) for financial transactions and administrative processing.
  • Service partners (authorized maintenance companies) to carry out maintenance or repairs.
  • IT and hosting providers who help us manage the cloud service, app and website.
  • government agencies (e.g. tax authorities) if required by law.

 

We conclude processor agreements with parties that process personal data on our behalf, so that they take appropriate technical and organizational measures.

7. Security

We take appropriate technical and organizational security measures to protect personal data against unlawful processing, loss or unauthorized access. Think of:

  • Encryption of data traffic (HTTPS) and encryption in our database, where possible;
  • secure access and authorization procedures;
  • Periodic evaluations of the security and software updates.

8. Your rights

Under the AVG you are entitled to:

  • Inspection: you can request which personal data we process from you;
  • Rectification: You can have incorrect or incomplete data corrected;
  • Deletion (“Right to be forgotten”): in certain cases you can ask us to delete your personal data;
  • Restriction of processing: You can request us to limit the processing of your personal data;
  • Transferability: in certain cases you can get a copy of your data in a common format;
  • Objection: You can object to a processing based on legitimate interest, including profiling, and specifically to direct marketing (see below 8.1).

 

8.1 Right of objection to direct marketing (mail / telephone)

  • If, on the basis of a legitimate interest, we approach you by telephone or by post with advertising or marketing purposes, you have the right to object free of charge and without giving a reason and to unsubscribe from further marketing.
  • Send a message to info@bhhrproducts.com or use the instructions in our communication. After receiving your objection, we will process this as soon as possible (at the latest within one month).

9. Complaints

If you have a complaint about the way we handle your personal data, please contact us first via info@bhhrproducts.com. If we cannot resolve it together, you have the right to submit a complaint to the Dutch Data Protection Authority (AP):https://www.autoriteitpersoonsgegevens.nl.

10. Changes

We may change this privacy statement from time to time to stay up-to-date with laws and regulations or changes to our business operations. You can always find the most current version at www.the-autogram.com.
